New Jersey Child Custody and Parenting time

In New Jersey, both parents must consent to permanent out-of-state relocation. If they cannot reach an agreement through negotiation or mediation, the matter will proceed to private arbitration or family court. The arbitrator or court will carefully consider multiple factors when deciding upon the proposed relocation, including:

  • The distance of the proposed move
  • The reasons for the proposed move
  • The good faith of the party proposing or opposing the move
  • The adverse impact on the children of the proposed move
  • Advantages for the moving parent and children in the proposed move
  • The ability (or lack of ability) of the resisting parent to relocate to the place of the proposed move

The courts are most concerned about the best interests of the child. The general consensus is that a child benefits the most from having both parents remain a constant presence in his or her life. However, it is not uncommon for judges to permit relocation, upon terms that will maintain strong ties between the removed children and their remaining parent. To successfully contest a proposed removal of children, the resisting parent must show that the proposed removal will cause severe harm to the children.
