Federal law protects employees from discrimination based on race, age, gender, sexual orientation, national origin and disability. New Jersey's Law Against Discrimination (LAD) takes these protections even further to include employees in same-sex relationships and transgender employees. These groups that are protected under state and federal laws are known as "protected classes." If you are a member of one of these protected classes and the bullying is directed at you because of this, you may have a discrimination claim against your employer.
But, what if you fall outside one of the protected classes? You still have options. Your employer has an obligation to prevent and prohibit employee bullying and harassment.
