Committing to Reaching an Agreement

Like other forms of alternative dispute resolution, collaborative law can reduce the stress and cost of going to trial. What sets collaborative law apart, however, is the commitment to reaching settlement without resorting to litigation.

At the start of the collaborative law process, both parties and their respective counsel sign an agreement. This agreement outlines their commitment to the negotiations by requiring both parties to seek new representation if the case ends up in litigation. This does not bar you from pursuing mediation or arbitration after using collaborative law or, conversely, using collaborative law after other forms of alternative dispute resolution have proved unsuccessful.
